These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Website”), all products, and services offered by Cartell Motors, Lda (“we”, “us”, “our”). By accessing, browsing, or placing an order on the Website, you agree to be bound by these Terms. If you do not agree, do not use the Website or purchase products from us.
1. Use of the Website
You must be at least 18 years old or have full legal capacity to enter into binding contracts to use this Website and place orders. You agree to provide accurate, current, and complete information when making purchases or creating an account. We reserve the right to suspend or terminate accounts for violations of these Terms.
2. Orders & Contracts
All orders placed are offers to purchase and are subject to final acceptance by us. We reserve the right to refuse or cancel any order (even after initial confirmation) for reasons including pricing errors, stock unavailability, suspected fraud, or legal restrictions. A binding sales contract is formed only when we send you an explicit order confirmation email.
Product images, descriptions, specifications, and prices are for guidance only and may contain technical errors. All prices listed exclude custom shipping costs, import duties, regional VAT, or specialized handling fees, which will be calculated individually.
3. Payment Terms
Full payment is required before we process, crate, and ship your order. We use secure third-party payment processors to complete all financial transactions. You are responsible for all additional bank transaction charges, international transfer fees, or currency conversion costs.
4. Shipping & Regional Scope
Shipping Scope: Cartell Motors, Lda exclusively sells and ships heavy automotive and marine components to destinations within Europe and the United States of America (USA). Orders outside these regions cannot be processed.
Shipping charges are not standardized and are calculated individually based on the exact specifications of the product and the delivery zip code. The risk of loss passes to you upon delivery or upon handover to the designated freight carrier. You must inspect all goods upon receipt and report visible transport damage or shortages within 48 hours.
5. Returns, Refunds & Warranty
- Right of Withdrawal: For retail consumers within the EU, you have a cooling-off period of 14 days from receipt to withdraw from the contract and return unused goods in their original crating and condition. Return shipping costs are entirely the customer's responsibility unless the component is fundamentally faulty.
- Warranty Limits: Most components come with a specified manufacturer or in-house warranty (typically 6–24 months, as stated on the product page). This covers material and remanufacturing workmanship defects only. It does not cover misuse, improper installation, racing/competition use, or standard wear and tear.
- Faulty Items: Defective items must be reported within the active warranty window accompanied by proof of purchase and diagnostic photos/videos. No returns are accepted for pre-owned or remanufactured parts unless explicitly faulty under warranty terms.
6. Intellectual Property
All layouts, graphics, text, diagrams, and media on this site are protected by copyright laws. Unauthorized commercial redistribution or replication of this content is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted by law, Cartell Motors, Lda shall not be held liable for indirect, consequential, special, or punitive damages (including loss of profits, commercial interruption, secondary vehicle damage, or vessel accidents). Our total liability shall under no circumstances exceed the exact dollar/euro amount paid for the specific product related to the claim.
8. Force Majeure
We are not responsible for delivery delays or mechanical fulfillment failures caused by events outside our reasonable sphere of control, including port strikes, customs holds, international trade restrictions, raw material supply disruptions, or natural disasters.
9. Governing Law & Dispute Resolution
These Terms & Conditions are governed by applicable standard regulations. Any legal disputes or litigation arising from transactions with Cartell Motors, Lda shall be submitted to the exclusive jurisdiction of the competent regional courts.
10. Revisions to Terms
We reserve the right to revise these terms seamlessly at any moment. The active version posted on this page at the exact time of order placement determines the governing rules.
